These Terms of Service ("Terms") govern your engagement with Zenith Digital ("we", "us", "our") for web design, SEO, AI integration, hosting, and related services. Please read them carefully. If anything is unclear, just ask.
1. Quotes & engagement
We provide a written quote before any work begins. A project is considered engaged once you accept the quote in writing (including by email or message). Prices are in Australian dollars and, unless stated otherwise, exclude GST.
2. Design preview & approval
For new website projects, we build a preview of your site before payment. The once-off design fee becomes payable once you approve the design and we proceed to launch. Reasonable revisions are included; substantial changes beyond the agreed scope may incur additional cost, which we'll always discuss with you first.
3. Payments
- Once-off design fees are payable on approval, prior to launch.
- Hosting and maintenance is billed monthly in advance.
- Larger projects may be split into instalments by agreement.
- Overdue accounts may result in services being paused until payment is received.
4. Hosting & maintenance
Our hosting and maintenance is offered on a month-to-month basis with no lock-in contract. You may cancel at any time with reasonable notice. On cancellation, we will provide your website files and assist with a smooth handover.
5. Ownership
Once all fees relating to a project are paid in full, you own the final website and its content. You own your domain name directly. Third-party components, fonts, and libraries remain subject to their respective licences.
6. Client responsibilities
You agree to provide content, branding, and feedback in a timely manner, and to ensure that any material you supply does not infringe the rights of others. Delays in providing materials may affect agreed timelines.
7. Results & warranties
We build every site with care and use industry best practices for performance and SEO. However, we cannot guarantee specific search rankings, traffic levels, or business outcomes, as these depend on factors outside our control. Nothing in these Terms limits any rights you have under the Australian Consumer Law.
8. Limitation of liability
To the extent permitted by law, our liability for any claim arising from our services is limited to the amount paid by you for the specific service giving rise to the claim. We are not liable for indirect or consequential loss.
9. Changes to these terms
We may update these Terms from time to time. The version in effect at the time of your engagement applies to that project. The latest version is always available on this page.
